Your privacy matters

1.1 This document uses the same terminology and abbreviations as our Terms of Service for Brands and Retailers. This policy governs the collection, use and storage of information obtained from users through our Site.

1.2 Information about users is divided into personally identifiable and non-personally identifiable information, depending on whether the information can identify the user as a specific person. Information about legal entities falls outside the scope of Information as defined in our Terms of Service and this Privacy Policy.

1.3 PrismaNote, Asperen, 4147 AV, the Netherlands, acts as “Controller” as defined by the EU GDPR for information we collect. You can reach us at info@prismanote.com.

PrismaNote acts as a “Processor” as defined by the EU GDPR for information provided to PrismaNote by parties other than the data subjects for purposes defined by Retailers or Brands. This policy covers only our role as Controller; for our role as Processor, see our Data Processing Agreement.

2.6 Some Services are not available if you do not provide the requested information. We may keep records of any inquiries, complaints or compliments submitted by you and any responses.

2.7 We do not sell or rent personal information to third parties. We use collected information for internal and marketing purposes only as required by the nature of our Services.

2.8 We have implemented security procedures and measures to protect the information we process. We will delete all information about you within forty-eight (48) hours of your request.

2.9 Only authorized processors have access to your information. If we ever detect or suspect a personal data breach we will notify the competent supervisory authority within seventy-two (72) hours.

2.10 Processing happens automatically, without human intervention. When you contact us by email the information is handled by a person to respond to your query.

2.11 Users can request access, correction and deletion of their personal information, and exercise the right to object, by emailing info@prismanote.com.

3.1 The site collects general data and information stored in server log files when a user or automated system accesses the site, such as browser types and versions, operating system, referrers, sub-sites visited, date and time of access, and the internet service provider.

3.2 We collect this information for breach investigation. We do not draw conclusions about the user from this data. The anonymous data is stored separately from any personal data provided by a data subject.

4.1 Information is stored on our secure servers in Ireland or Berlin. Servers are monitored and maintained with adequate privacy safeguards.

4.2 Information is only stored for the duration necessary to deliver the Services. We keep records of processing activities to demonstrate compliance with the EU GDPR.

5.1 If you register an account we retain your data for as long as your account is active. Once you delete your account we delete the information we have collected about you, retaining backups for up to 30 days.

5.2 If you do not have an account but provided personal information, we delete this information 180 days after collection.

6.1 You can request: disclosure of whether your personal information is being processed and access to it; a copy in a structured, commonly used and machine-readable format; correction; deletion; objection to processing; restriction of processing; and lodging a complaint with a supervisory authority.

6.2 These rights may be limited where they conflict with PrismaNote's own legitimate interests and legal requirements.

8.1 The Site or emails may contain links to external websites we do not control. We are not responsible for their privacy practices or content.

8.6 LinkedIn Insight Tag — analytics, marketing and retargeting on info.prismanote.com.

8.7 ActiveCampaign website tracking — email personalisation.

9.1 We reserve the right to modify this policy at any time. The current version is available on the Site with its effective date. We encourage you to review it regularly.
